SECOND AMENDMENT TO KELLIWOOD TERRACE, SECTION ONE RESTRICTIONS THE STATE OF TEXAS COUNTY OF FORT BEND WHEREAS, Willow Fork Associates, Ltd., as Declarant, caused that certain instrument entitled "Kelliwood Terrace, Section One Restrictions" ("the Restrictions") to be recorded in the Real Property Records of Fort Bend County, Texas on June 26, 1989 under Clerk’s File No. 8932606, which restrictions imposed various covenants, conditions and restrictions upon the following properties, to-wit: and, WHEREAS, the Restrictions were previously amended by instrument entitled "First Amendment to Kelliwood Terrace, Section One Restrictions" ("the First Amendment") recorded in the Real Property Records of Fort Bend County, Texas on October 6, 1989 under Clerk’s File No. 8950885; and WHEREAS, the Restrictions provide for amendment during the first twenty (20) year period thereof by an instrument signed by the owners of not less than seventy-five percent (75%) of the lots; and WHEREAS, the undersigned, being the owners of not less than seventy-five percent (75%) of the lots subject to the Restrictions desire to further amend the Restrictions; NOW, THEREFORE, the undersigned, being the owners of not less than seventy-five (75%) of the lots in Kelliwood Terrace, Section One, subject to the Restrictions, hereby amend the Restrictions as follows:
74431-1 Paragraph 1 of the First Amendment is hereby deleted in its entirety, it being the intent of this amendment to authorize the Maintenance Fund to be used for whatever purposes, including capital improvements, deemed by Kelliwood Fund, Inc., to be of general benefit to the owners or occupants of lots subject to the Restrictions. Except as amended herein, all provisions in the Restrictions remain in full force and effect. Executed on the dates set forth below, to be effective upon recording in the Official Public Records of Real Property of Fort Bend County, Texas.
